M\u00edsto toho poprv\u00e9 vznik\u00e1 jednotn\u00fd r\u00e1mec pro v\u0161ech 27 \u010dlensk\u00fdch st\u00e1t\u016f. To, co je v N\u011bmecku pova\u017eov\u00e1no za pr\u00e1vn\u011b vyhovuj\u00edc\u00ed identifikaci, se m\u016f\u017ee v\u00fdrazn\u011b li\u0161it od po\u017eadavk\u016f ve Francii, \u0160pan\u011blsku nebo It\u00e1lii. Pro mezin\u00e1rodn\u011b p\u016fsob\u00edc\u00ed banky a finan\u010dn\u00ed instituce to dosud znamenalo vysok\u00e9 n\u00e1klady, komplexn\u00ed procesy a samostatn\u00e9 onboardingov\u00e9 cesty pro ka\u017ed\u00fd trh. S AMLR tento model kon\u010d\u00ed. Jako na\u0159\u00edzen\u00ed plat\u00ed p\u0159\u00edmo ve v\u0161ech \u010dlensk\u00fdch st\u00e1tech EU a ji\u017e nevy\u017eaduje n\u00e1rodn\u00ed transpozici. Prostor pro rozd\u00edln\u00e9 interpretace se t\u00edm v\u00fdrazn\u011b sni\u017euje.       <\/p><p><a href=\"https:\/\/eur-lex.europa.eu\/DE\/legal-content\/summary\/preventing-abuse-of-the-financial-system-for-money-laundering-and-terrorism-purposes-from-2027.html\" target=\"_blank\" rel=\"noopener\">AMLR poprv\u00e9 jasn\u011b vymezuje<\/a>, kter\u00e9 digit\u00e1ln\u00ed postupy budou do budoucna povoleny pro identifikaci v kontextu prevence pran\u00ed pen\u011bz.<\/p><p>V centru stoj\u00ed t\u0159i celoevropsky uzn\u00e1van\u00e9 metody:<\/p><ul><li><strong>N\u00e1rodn\u00ed elektronick\u00e9 identity (eID):<\/strong> Digit\u00e1ln\u00ed identity vyd\u00e1van\u00e9 st\u00e1tem s \u00farovn\u00ed d\u016fv\u011bry \u201esubstantial\u201c nebo \u201ehigh\u201c.<\/li><li><strong>European Digital Identity Wallet (EUDI-Wallet):<\/strong> Do konce roku 2026 mus\u00ed ka\u017ed\u00fd \u010dlensk\u00fd st\u00e1t poskytnout <a href=\"https:\/\/nect.com\/cs\/produkty\/eudi-penezenka-nova\/\" target=\"_blank\" rel=\"noopener\">EUDI-Wallet<\/a>. Ob\u010danky a ob\u010dan\u00e9 v n\u00ed budou moci do budoucna pou\u017e\u00edvat digit\u00e1ln\u00ed doklady identity nap\u0159\u00ed\u010d Evropou. <\/li><li><strong>Qualified Trust Services (QTS):<\/strong> Pat\u0159\u00ed sem zejm\u00e9na Qualified Electronic Signatures (QES) a Qualified Electronic Attestations of Attributes (QEAA), kter\u00e9 poskytuj\u00ed kvalifikovan\u00ed poskytovatel\u00e9 slu\u017eeb vytv\u00e1\u0159ej\u00edc\u00edch d\u016fv\u011bru.<\/li><\/ul><p>Postupy zalo\u017een\u00e9 na dokladech z\u016fst\u00e1vaj\u00ed nad\u00e1le mo\u017en\u00e9, pokud spl\u0148uj\u00ed po\u017eadavky <a href=\"https:\/\/www.etsi.org\/deliver\/etsi_ts\/119400_119499\/119461\/02.01.01_60\/ts_119461v020101p.pdf\" target=\"_blank\" rel=\"noopener\">normy ETSI 119 461<\/a>. N\u011bmeck\u00fd z\u00e1kon o pran\u00ed pen\u011bz (GwG) dosud v z\u00e1sad\u011b umo\u017e\u0148oval \u010dty\u0159i zp\u016fsoby vzd\u00e1len\u00e9 identifikace: <\/p><ul><li>Osobn\u00ed identifikace, nap\u0159\u00edklad na pobo\u010dce nebo p\u0159es PostIdent<\/li><li>Video-Ident prost\u0159ednictv\u00edm \u017eiv\u00e9ho videohovoru s vy\u0161kolen\u00fdmi zam\u011bstnanci<\/li><li>Vyu\u017eit\u00ed funkce online ob\u010dansk\u00e9ho pr\u016fkazu (eID)<\/li><li>Kvalifikovan\u00fd elektronick\u00fd podpis v kombinaci s referen\u010dn\u00ed platbou<\/li><\/ul><p>Trh po \u0159adu let formovaly p\u0159edev\u0161\u00edm po\u017eadavky na Video-Ident. Podle pokyn\u016f BaFin muselo ov\u011b\u0159en\u00ed identity prob\u00edhat v re\u00e1ln\u00e9m \u010dase a prov\u00e1d\u011bt je speci\u00e1ln\u011b vy\u0161kolen\u00ed zam\u011bstnanci. Pln\u011b automatizovan\u00e9 postupy nebo ov\u011b\u0159ov\u00e1n\u00ed identity s podporou AI nebyly pro p\u0159\u00edpady pou\u017eit\u00ed regulovan\u00e9 GwG uzn\u00e1v\u00e1ny jako rovnocenn\u00e1 alternativa. Vznikl tak paradox: zat\u00edmco v jin\u00fdch evropsk\u00fdch zem\u00edch ji\u017e byly modern\u00ed technologie pro regulovanou identifikaci povoleny, n\u011bmeck\u00fd trh z\u016fst\u00e1val z velk\u00e9 \u010d\u00e1sti odk\u00e1z\u00e1n na manu\u00e1ln\u00ed postupy Video-Ident. D\u016fsledky byly z\u0159ejm\u00e9: v\u00fdrazn\u011b vy\u0161\u0161\u00ed procesn\u00ed n\u00e1klady, omezen\u00e1 \u0161k\u00e1lovatelnost, del\u0161\u00ed doby dokon\u010den\u00ed a \u010dasto slab\u0161\u00ed u\u017eivatelsk\u00fd z\u00e1\u017eitek.    <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f27283c elementor-widget elementor-widget-heading\" data-id=\"f27283c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Co se s AMLR m\u011bn\u00ed<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0d99267 elementor-widget elementor-widget-text-editor\" data-id=\"0d99267\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\tS nabyt\u00edm \u00fa\u010dinnosti AMLR budou n\u00e1rodn\u00ed zvl\u00e1\u0161tn\u00ed \u00fapravy pro identifika\u010dn\u00ed postupy v oblasti AML z velk\u00e9 \u010d\u00e1sti nahrazeny evropsk\u00fdmi po\u017eadavky. Pro banky, poji\u0161\u0165ovny a dal\u0161\u00ed regulovan\u00e9 spole\u010dnosti to znamen\u00e1 p\u0159edev\u0161\u00edm jedno: identifikace z\u00e1kaznic a z\u00e1kazn\u00edk\u016f bude nap\u0159\u00ed\u010d Evropou jednotn\u011bj\u0161\u00ed, p\u0159edv\u00eddateln\u011bj\u0161\u00ed a snadn\u011bji \u0161k\u00e1lovateln\u00e1. Nam\u00edsto nutnosti p\u0159izp\u016fsobovat se r\u016fzn\u00fdm n\u00e1rodn\u00edm po\u017eadavk\u016fm budou se firmy moci do budoucna v\u00fdrazn\u011b v\u00edce op\u00edrat o standardizovan\u00e9 procesy. Z\u00e1rove\u0148 se digit\u00e1ln\u00ed \u0159e\u0161en\u00ed identity dost\u00e1vaj\u00ed do centra regulatorn\u00edch po\u017eadavk\u016f. Qualified Trust Services budou do budoucna pat\u0159it mezi v\u00fdslovn\u011b uzn\u00e1van\u00e9 metody identifikace. Firmy tak z\u00edskaj\u00ed dal\u0161\u00ed mo\u017enosti, jak plnit regulatorn\u00ed po\u017eadavky, ani\u017e by byly odk\u00e1z\u00e1ny na n\u00e1kladn\u00e9 a person\u00e1ln\u011b n\u00e1ro\u010dn\u00e9 postupy.      \n\nUstupuje tak\u00e9 dosud dominantn\u00ed role n\u00e1rodn\u00edch zvl\u00e1\u0161tn\u00edch \u00faprav, nap\u0159\u00edklad n\u011bmeck\u00fdch po\u017eadavk\u016f na postupy Video-Ident.
